Terms of Service

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.

You may not use the Service if you are barred from doing so under applicable law.

2. The Service

Pursue is an AI-assisted coaching application designed to help you discover, plan, and pursue meaningful personal projects.

The Service provides automated and AI-generated guidance, planning, feedback, and encouragement. It is not a substitute for professional advice.

3. Important health and safety disclaimer

Pursue is not a medical, mental-health, therapeutic, crisis-intervention, or emergency service. AiGen is not a licensed healthcare provider, therapist, counselor, or crisis center.

The Service does not diagnose, treat, or prevent any condition. AI responses may be wrong, incomplete, or inappropriate. Do not rely on the Service for decisions that could affect your health, safety, finances, or legal rights.

If you are in crisis or may harm yourself or others, contact local emergency services immediately. In the United States, you can call or text 988 for the Suicide & Crisis Lifeline.

Pursue includes automated crisis-aware messaging in some situations, but this is not a substitute for professional help.

4. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate information and to notify us promptly at aigenapps@gmail.com if you suspect unauthorized access.

5. User content

You retain ownership of the dreams, goals, notes, uploads, and other content you submit to the Service ("User Content").

You grant AiGen a limited, non-exclusive, worldwide license to host, store, reproduce, process, and display User Content solely to operate, provide, maintain, and improve the Service, including transmitting relevant content to AI and infrastructure providers as described in our Privacy Policy.

You represent that you have the rights to submit your User Content and that it does not violate any law or third-party rights.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Upload content you do not have the right to share, including others' personal data without consent.
• Attempt to probe, scan, or test the vulnerability of the Service or circumvent access controls.
• Reverse engineer, decompile, or attempt to extract source code except where permitted by law.
• Use the Service to generate spam, harassment, hate speech, or content that exploits or harms others.
• Interfere with or disrupt the Service or its infrastructure.

7. Subscriptions, billing, and founding-member pricing

Pursue offers a Free tier and a paid Pro subscription.

Pro founding-member pricing (locked for the life of an active subscription while it remains continuously active): $9.99/month or $59.99/year, billed through the Apple App Store or Google Play Store. Standard pricing after launch is expected to be $19.99/month or $99.99/year for new subscribers who are not eligible for founding-member pricing.

Eligible first-time Pro subscribers may receive a 7-day free trial, where offered by the applicable store. You will be charged when the trial ends unless you cancel before it expires.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your store account will be charged for renewal within 24 hours prior to the end of the current period.

You manage, change, or cancel subscriptions through your Apple ID or Google Play account settings. Deleting the app does not cancel your subscription.

Refunds are handled by Apple or Google according to their policies. AiGen does not control store refund decisions.

We may change pricing, features, or plan structures for new subscribers in the future. Founding-member pricing remains locked only for qualifying active subscribers as described in the app and at purchase.

8. Intellectual property

The Service, including its design, branding, software, prompts, and content provided by AiGen, is owned by AiGen or its licensors and is protected by intellectual property laws.

Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

9. Privacy

Our Privacy Policy explains how we collect and use information. By using the Service, you also agree to our Privacy Policy.

10. Termination

You may stop using the Service at any time and may request account deletion by emailing aigenapps@gmail.com.

We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service.

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive, including disclaimers, limitations of liability, and dispute provisions.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI OUTPUTS WILL BE ACCURATE OR SUITABLE FOR ANY PURPOSE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIGEN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIGEN'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AIGEN FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless AiGen from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

Before filing a claim, you agree to contact us at aigenapps@gmail.com and attempt to resolve the dispute informally.

Except where prohibited by applicable law, any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

15. Changes to these Terms

We may modify these Terms from time to time. If we make material changes, we will provide at least 30 days' notice by email, in-app notice, or by posting updated Terms before they take effect.

If you do not agree to the updated Terms, you must stop using the Service before they become effective.
